The United States Supreme Court Denies Cert. in Pavlock v. Holcomb

On October 31st, the US Supreme Court denied a petition for certiorari filed by private landowners in the Pavlock case, declining to consider the legal questions posed by petitioners and to require further consideration by the 7th Circuit.

The case was brought in the Northern District of Indiana and dismissed without prejudice by the 7th Circuit for a lack of standing.

The Pavlocks claimed that the Indiana Supreme Court, in its 2018 Gunderson decision, committed a judicial taking by affirming the State’s historical ownership of its Lake Michigan shores as trustee for the public.

The Conservation Law Center is pleased with this outcome and will continue to advocate for the protection of the right of all people to enjoy our shared public trust resources in Indiana and beyond.
